The company Ferdinand Stükerjürgen GmbH & Co. KG, Grüner Weg 4, 33397 Rietberg, Germany, takes data protection seriously and wishes to ensure that your privacy is protected when using the websites of Ferdinand Stükerjürgen GmbH & Co. KG. The legal basis of data protection can be found in the European Data Protection Ordinance (EU DS-GVO) and the new Federal Data Protection Act (BDSG new). Legal basis for processing

The basis for data processing is Art. 6 para. 1 lit. b DS-GMO, which permits the processing of data for the fulfilment of a contract or pre-contractual measures.

In rare cases, the processing of personal data may become necessary to protect the vital interests of a person concerned or another natural person. This would be the case, for example, if a visitor were injured in our company and their name, age, health insurance data or other vital information had to be passed on to a doctor, a hospital or other third parties. The processing would then be based on Art. 6 lit. d DS-GVO.

Cookies, which are necessary for the execution of the electronic communication process, are stored on the basis of Art. 6 para. 1 lit. f DS-GVO.

Submitted application documents via the contact form on our website will be processed on the basis of Art. 6 para. 1 lit. f DS-GVO.

TLS encryption with https

We use https to transmit data tap-proof on the Internet (data protection through technology design article 25 paragraph 1 DSGVO). By using TLS (Transport Layer Security), an encryption protocol for secure data transmission on the Internet, we can ensure the protection of confidential data. You can recognize the use of this data transmission security by the small lock symbol in the upper left corner of your browser and the use of the https scheme (instead of http) as part of our Internet address.

Personal Information

We collect, process and use your personal data only with your consent or if permitted by law. We will only collect, process and use such personal data as is necessary for the performance and use of our services or which you voluntarily provide to us.

Personal data are all data that contain information about personal or factual circumstances of a specific or identifiable customer. These include, for example, your name, e-mail address, home address, gender, date of birth, telephone number or age.

Purposes of the collection of personal data

We need your personal data for the following purposes:

  • To process your enquiries/orders (your e-mail address, registered office of your company, your delivery address),
  • to answer your questions (your e-mail address, your telephone number if applicable)
  • Integration of maps from the "Google Maps" service.

Consent and revocation

If you have given us your consent to the use, processing and transmission of your personal data for marketing purposes, you can revoke this consent at any time with effect for the future without observing a specific form or period. In addition, you may - insofar as we use your data within legally permissible limits, for example for postal marketing measures - object to this use. All you need to do is send us an informal e-mail. The legality of the data processing up to the revocation remains unaffected by the revocation.

After your revocation we will use your data exclusively for the processing of your order and refrain from sending further advertising material.

Log files

Whenever you access our website, information (so-called server log files) is automatically collected. The information includes the name of the requested website or data file, date and time of the call, transmitted data, notification of successful call-off, browser¬type in addition to version, the user's operating system, referrer URL (the page visited before), IP address and the requesting provider. Processing is carried out in accordance with Art. 6 Para. 1 lit. f DSGVO on the basis of our legitimate interest in optimising our website and maintaining its functionality.

Log file information is stored for 7 days for security reasons (e.g. to clarify misuse or defraudation) and then deleted. Data which require further storage for evidence shall be excluded from deletion until the respective matter has been conclusively resolved.

Right of appeal to the competent supervisory authority

In the event of breaches of data protection law, the person concerned has a right of appeal to the competent supervisory authority. The responsible supervisory authority for data protection issues is the data protection officer of the federal state in which our company is based. Right to data transferability

You have the right to have data which we automatically compile on the basis of your consent or in fulfilment of a contract handed over to yourself or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another person responsible, this will only take place if it is technically feasible.

Information, blocking (restriction), deletion

Within the framework of the applicable legal provisions, you have the right at any time to receive free information about your stored personal data, their origin and recipients and the purpose of data processing and, if necessary, a right to report, block, restrict or delete these data at any time within the scope of the applicable legal provisions. You can contact us at any time at the address given under contact data as well as for further questions on the subject of personal data.

Contact form

If you send us enquiries using the contact form, your details from the enquiry form, including the contact data you provided there, will be stored for the purpose of processing the enquiry and in the event of follow-up questions. This personal data is not passed on to third parties.
The data entered in the contact form is processed exclusively on the basis of the fulfilment of a contract or for the implementation of pre-contractual measures (Art. 6 para. 1 lit. b DS-GVO).

The data you enter in the contact form will remain with us until you request us to delete it or the purpose for storing the data no longer applies. Mandatory statutory provisions - in particular retention periods - remain unaffected.

Google Maps

This site uses the map service Google Maps via an API. The provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

To use the functions of Google Maps it is necessary to store your IP address. This information is usually transferred to a Google server in the USA and saved there. The provider of this site has no influence on this data transfer.

The use of Google Maps is in the interest of an pleasant presentation of our online offers and easy findability of the locations mentioned on the website. This represents a legitimate interest in the sense of Art. 6 Para. 1 lit. f DSGVO.

Google Web Fonts

This site uses web fonts provided by Google for the representation of fonts. When you call up a page, your browser loads the required web fonts into its browser cache in order to display texts and fonts correctly.

For this purpose, the browser you use must connect to Google's servers. This enables Google to know that our website has been accessed via your IP address. The use of Google Web Fonts is in the interest of a uniform and attractive presentation of our online offers. This represents a legitimate interest in the sense of Art. 6 para. 1 lit. f DSGVO.

Google Analytics (with anonymization function)

On the basis of our legitimate interests (i.e., interest in the analysis, optimization and economic operation of our online offering within the meaning of point (f) of Article 6(1) GDPR) we use Google Analytics, a web analysis service of Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA (“Google”). Google uses cookies. The information generated by the cookies about the user’s use of the online offering is generally transmitted to a Google server in the USA and stored there. 

We use the “_gat._anonymizeIp” add-on for web analysis with Google Analytics. Use of this add-on means that the IP address of the data subject’s Internet connection is shortened and anonymized by Google if our website is accessed from a member state of the European Union or from another state that is a party to the Agreement on the European Economic Area. The purpose of the Google Analytics component is to analyse the flow of visitors to our website. One of the purposes for which Google uses the data and information obtained is to evaluate the use of our website in order to compile online reports for us showing the activities on our website and to provide further services in connection with the use of our website. Google Analytics places a cookie on the data subject’s terminal equipment. Placing the cookie enables Google to analyse the use of our website. Each time one of the individual pages of our website on which a Google Analytics component has been integrated is called up, the internet browser on the data subject’s terminal equipment is automatically prompted by the respective Google Analytics component to transmit data to Google for the purpose of online analysis. In the context of this technical process, Google obtains knowledge of personal data, such as the IP address of the data subject, which is used by Google among other things to trace the origin of visitors and clicks and subsequently to enable commission settlements.

Cookies are used to store personal information such as the time of access, the location from which access was made and the frequency of visits to our website by the data subject. Whenever you visit our website, this personal data, including the IP address of the internet connection used by the data subject, is transmitted to Google Inc. in the USA. This personal data is stored by Google Inc. in the USA for 14 months. Google Inc. may pass on this personal data collected in the technical process to third parties. The data subject can prevent cookies from being placed by our website at any time by means of a corresponding setting in the internet browser used, thus permanently objecting to the placement of cookies. If the internet browser used is set in this way, this would also prevent Google from placing a cookie on the data subject’s information technology system. In addition, a cookie already placed by Google Analytics can be deleted at any time via the internet browser or other software programs.

Furthermore, the data subject has the possibility of objecting to and preventing the collection of data generated by Google Analytics and relating to the use of our website as well as the processing of this data by Google. To do so, the data subject must download and install a browser add-on from http://tools.google.com/dlpage/gaoptout?hl=en-GB. This browser add-on informs Google Analytics via JavaScript that no data and information about visits to websites may be transmitted to Google Analytics. Installation of the browser add-on is deemed by Google to constitute objection. If the data is deleted, formatted or reinstalled on the data subject’s terminal equipment at a later date, the data subject must reinstall the browser add-on in order to disable Google Analytics. If the browser add-on is removed or disabled by the data subject or another person within their sphere of control, it is possible to reinstall or reactivate the browser add-on.

Facebook pixel

On the basis of our legitimate interests pursuant to point (f) of Article 6(1) GDPR in the analysis, optimisation and economic operation of our online offering, the so-called “Facebook pixel” of the social network Facebook, which is operated by Facebook Inc, 1 Hacker Way, Menlo Park, CA 94025, USA, or, if you are resident in the EU, Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”), is used within our online offering.  

The Facebook pixel enables Facebook on the one hand to define the visitors to our online offering as a target group for the presentation of advertisements (so-called “Facebook ads”). We accordingly use the Facebook pixel to display the Facebook ads placed by us only to those Facebook users who have also shown an interest in our online offering or who exhibit certain characteristics (e.g., interest in certain topics or products determined on the basis of the websites visited) which we transmit to Facebook (so-called "custom audiences"). By using the Facebook pixel, we seek to ensure that our Facebook ads match the potential interest of the users and do not cause annoyance. Hosted by Shopify

We use the shop system of the service provider Shopify International Limited, Victoria Buildings, 2nd floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland ("Shopify"), for the purpose of hosting and displaying the online shop on the basis of a Processing on our behalf. All data collected on our website is processed on Shopify's servers. As part of the aforementioned Shopify services, data can also be processed further on behalf of Shopify Inc., 150 Elgin St, Ottawa, ON K2P 1L4, Canada, Shopify Data Processing (USA) Inc., Shopify Payments (USA) Inc . or Shopify (USA) Inc. In case of the transmission of data to Shopify Inc. in Canada, the appropriate level of data protection is guaranteed by the adequacy decision of the European Commission. Further processing on servers other than those mentioned above by Shopify only takes place within the framework communicated below.

Data processing for order treatment

1) To process your order, we work together with the following service provider (s) who support us in whole or in part in the execution of concluded contracts. Certain personal data is transmitted to these service providers in accordance with the following information.

The personal data collected by us will be passed on to the transport company commissioned with the delivery as part of the contract processing, insofar as this is necessary for the delivery of the goods. We will pass on your payment data to the commissioned credit institution as part of the payment processing, if this is necessary for the payment treatment. If payment service providers are used, we will explicitly inform you about this below. The legal basis for the transfer of data is Art. 6 Paragraph 1 lit. b GDPR.

2)  In order to fulfill our contractual obligations towards our customers, we work together with external shipping partners. We pass on your name and delivery address and, if necessary for the delivery, your telephone number, exclusively for the purpose of delivery of goods, Article 6 (1) (b) GDPR, to a shipping partner selected by us.

3) Use of payment service providers (payment services)

Paypal

When paying via PayPal, credit card via PayPal, direct debit via PayPal or - if offered - "purchase on invoice" or " instalment payment " via PayPal, we give your payment data to PayPal (Europe) S.a.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter "PayPal") as part of the payment processing. The transfer takes place in accordance with Art. 6 Par. 1 lit. b GDPR and only insofar as this is necessary for payment processing.

PayPal reserves the right to carry out a credit check for the payment methods credit card via PayPal, direct debit via PayPal or - if offered - "purchase on invoice" or "instalment payment " via PayPal. For this purpose, your payment data may be passed on to credit agencies in accordance with Article 6 (1) (f) GDPR on the basis of PayPal's legitimate interest in determining your solvency. PayPal uses the result of the credit check with regard to the statistical probability of default for the purpose of deciding on the provision of the respective payment method. The credit report can contain probability values (so-called score values). As far as score values are included in the result of the credit report, they are based on a scientifically recognized mathematical-statistical procedure. The calculation of the score values includes, but is not limited to, address data. You can disagree to this processing of your data at any time by sending a message to PayPal. However, PayPal may still be entitled to process your personal data if this is necessary for contractual payment processing.

Applications

If you apply for a job via the Stükerjürgen application portal, application form or in any other way and send us your application documents. We will process the personal data provided by you only for the purpose of the application process.

If you have applied for an advertised position, your documents will be automatically deleted six months after the end of the application procedure, if there are no legitimate interests preventing deletion. In the case of an application without reference to an advertised position (unsolicited application), the application will be kept for a maximum period of one year in order to contact you, if necessary, with regard to any job advertisement that may arise during this period. You have the opportunity to request the deletion of your application at any time, even before the expiry of the intended retention period. In the event of a successful application, the transmitted data will be stored for the purpose of processing the employment relationship in compliance with the legal requirements.

As far as we process your data for the decision on the establishment of an employment relationship, the legal basis is § 26 para. 1 sentence 1 of the Federal Data Protection Act.

In all other cases, the legal basis for the storage of your applicant data is your consent in accordance with Art. 6 para. 1 lit. a) DSGVO.

Duration for which the personal data are stored

The criterion for the duration of the storage of personal data is the respective legal retention period. After the expiry of this period, the corresponding data will be routinely deleted, provided that they are no longer necessary for the fulfilment or initiation of the contract.

Cookies

The Internet pages of Ferdinand Stükerjürgen GmbH & Co KG use cookies. Cookies are text files which are stored on a computer system via an Internet browser. Many cookies contain a so-called cookie ID. A cookie ID is a unique identification of the cookie. It consists of a string of characters through which Internet pages and servers can be assigned to the specific Internet browser in which the cookie was stored. This enables the visited Internet pages and servers to distinguish the individual browser of the person concerned from other Internet browsers that contain other cookies. A particular Internet browser can be recognized and identified by its unique cookie ID.
